Friends, Let’s see that The Rapist Should Be Given A Punishment. This fight is not the boys or girls or any cast or religion but it’s a fight between the perpetrator and the victim. What type of punishment should be given to the victim? Friends, this situation is not occurring in the village or any other place it occurs in Hyderabad. This was the city all around there are CCTV cameras but after that how it can occur? According to our Indian constitution, there is a right for the victim to occur murder the person who has to occur is the victim.
The second thing is what amount of punishment is given to the guilty. There are continuous occur changes in the IPC. There are changes according to the situation like the rape is a gang rape or occurs by only one person etc. And the second thing is that the guilty occur the crime at which time first time or second time or another. If they occur one time then the punishment is different and if by second time so the punishment is different. We want that why not the statement is given in only one line that whoever commits rape shall be guilty of the offense under section 376 and shall be punished with the death penalty.
Only my one question is – be part of judicial modernity.
(1) Whoever, except in the cases provided for in subsection (2), commits rape, shall be punished with rigorous imprisonment of either description for a term which shall not be less than ten years, but which may extend to imprisonment for life, and shall also be liable to fine.
(2) Whoever,—
(a) being a police officer commits rape—
(i) within the limits of the police station to which such police officer is appointed; or
(ii) in the premises of any station house; or
(iii) on a woman in such police officer’s custody or the custody of a police officer subordinate to sa such police officer; or
(b) being a public servant commits rape on a woman in such public servant’s custody or the custody of a public servant subordinate to such public servant; or
(c) being a member of the armed forces deployed in an area by the Central or a State Government committing rape in such area; or
(d) being on the management or the staff of a jail, remand home, or another place of custody established by or under any law for the time being in force or of a women’s or children’s institution commits rape on any inmate of such jail, remand home, place or institution; or
(e) being on the management or the staff of a hospital committing rape on a woman in that hospital; or
(f) being a relative, guardian, or teacher of, or a person in a position of trust or authority towards the woman, commits rape on such woman; or
(g) commits rape during communal or sectarian violence; or
(h) commits rape on a woman knowing her to be pregnant; or
